Data Usage & Buyer Responsibility Policy

FusionByte Media LLC (“FusionByte,” “we,” “us,” or “our”) provides marketing leads, data services, and related technology solutions (“Services”) to buyers, clients, and partners (“Buyers”). This Data Usage & Buyer Responsibility Policy (“Policy”) governs how Buyers may access, use, store, and protect any data, leads, or information provided by FusionByte (“Data”).

By accessing or using any Data from FusionByte, Buyers agree to comply with this Policy, our Terms and Conditions, Privacy Policy, TCPA & Consent Compliance Policy, and any applicable written agreements.

1. Permitted Use of Data

Data provided by FusionByte may be used solely for:

  • Lawful contact or evaluation of the consumer consistent with the consumer’s disclosed consent

  • Internal business evaluation, intake qualification, or case screening

  • Compliance documentation and recordkeeping

  • Purposes expressly authorized in a written agreement with FusionByte

Any use outside these purposes is strictly prohibited.

2. Prohibited Use

Buyers shall not:

  • Resell, sublicense, distribute, syndicate, or transfer Data to any third party without written authorization

  • Use Data for unrelated marketing, cross-selling, list-building, or enrichment

  • Combine Data with unrelated datasets for profiling or monetization

  • Engage in automated scraping, replication, or database harvesting

  • Misrepresent FusionByte as the source or owner of the Data

  • Retain Data beyond permitted retention periods

  • Use Data in violation of any applicable law or regulation

3. Buyer Compliance Responsibility

Buyers are solely responsible for:

  • Compliance with all applicable laws and regulations, including but not limited to TCPA, FCC rules, CAN-SPAM, state telemarketing laws, privacy regulations, and carrier requirements

  • Maintaining compliant dialing systems, messaging platforms, scripts, opt-out handling, and suppression lists

  • Performing internal Do-Not-Call (DNC) scrubbing and honoring consumer opt-outs

  • Ensuring personnel training and monitoring

  • Maintaining audit trails and documentation

FusionByte does not control buyer operations, calling practices, messaging content, or system configurations.

4. Data Security Obligations

Buyers must implement reasonable administrative, technical, and physical safeguards to protect Data, including:

  • Restricted access controls

  • Secure storage and encryption where appropriate

  • Monitoring for unauthorized access or misuse

  • Incident response procedures

Buyers must promptly notify FusionByte of any suspected data breach, misuse, or unauthorized disclosure involving FusionByte Data.

5. Data Retention and Deletion

Buyers may retain Data only as long as reasonably necessary for permitted purposes or legal obligations. Upon request or termination of relationship, Buyers shall securely delete or return Data unless legally required to retain it.

6. Audit and Verification Rights

FusionByte reserves the right, upon reasonable notice, to request written confirmation of compliance or audit relevant usage practices to verify adherence to this Policy.

Failure to cooperate may result in suspension or termination of access.

7. No Ownership Transfer

All Data remains the property of FusionByte or its licensors. Buyers receive a limited, revocable, non-transferable license to use Data solely as permitted under this Policy and applicable agreements.

8. Indemnification

Buyers agree to defend, indemnify, and hold harmless FusionByte, its officers, employees, contractors, and affiliates from any claims, damages, fines, penalties, investigations, or liabilities arising from:

  • Buyer’s misuse of Data

  • Buyer’s regulatory violations

  • Buyer’s failure to maintain compliance

  • Buyer’s breach of this Policy or any agreement

9. Suspension and Termination

FusionByte may immediately suspend or terminate Data access if:

  • Buyer violates this Policy

  • Buyer creates regulatory or reputational risk

  • Buyer fails to cooperate with compliance inquiries

No refunds or credits shall be owed for suspension due to Buyer violation unless otherwise agreed in writing.

10. Policy Updates

FusionByte may modify this Policy at any time. Updates will be posted on the Website and become effective upon posting.
