TCPA & Consent Compliance Policy

This TCPA & Consent Compliance Policy describes how FusionByte collects, validates, stores, and distributes consumer consent for marketing leads and how buyers and partners are required to use such data.

This policy applies to all visitors, clients, buyers, publishers, vendors, and partners engaging with FusionByte services.

2. Consent Collection Standards

FusionByte collects or sources consumer data only from campaigns that require:

a) Clear and Conspicuous Disclosure

Consumers are presented with visible disclosures explaining:

  • The purpose of data collection

  • That they may be contacted by telephone, SMS, or email

  • That automated technology or prerecorded messages may be used (where applicable)

  • That consent is not a condition of purchase

  • Identity of the advertiser or lead recipient category


b) Express Written Consent

Where required by law, consumers provide express written consent by:

  • Checking an unchecked opt-in box

  • Submitting a web form

  • Electronic signature or equivalent affirmative action

Consent is captured and recorded with timestamp, IP address, URL, and user agent data.


c) No Pre-Checked Boxes or Passive Consent

FusionByte does not knowingly accept passive, implied, or pre-checked consent mechanisms.


3. Consent Documentation and Audit Trail

FusionByte maintains or receives verifiable consent documentation, which may include:

  • TrustedForm or equivalent certificates

  • Source URL and landing page snapshot

  • Timestamp and IP address

  • Consumer-submitted form fields

  • Disclosure text version

  • Device and browser metadata

Consent records are retained in accordance with legal and contractual requirements and may be made available to buyers upon legitimate request for compliance verification.


4. Traffic Quality and Source Controls

FusionByte enforces quality controls across inbound traffic sources, including:

  • Publisher vetting and onboarding

  • Traffic monitoring and anomaly detection

  • Prohibition of incentivized, auto-filled, bot-generated, or recycled data

  • Validation checks for phone format, duplication, and consistency

  • Manual and automated fraud prevention measures

Traffic sources failing compliance standards may be suspended or terminated.


5. Do-Not-Call (DNC) and Suppression Handling

FusionByte supports compliance with:

  • National Do Not Call Registry

  • Internal suppression lists

  • Opt-out requests captured at the point of submission (where applicable)

Buyers remain responsible for their own DNC scrubbing, internal suppression management, and honoring consumer opt-out requests after lead delivery.


6. Data Delivery and Permitted Use

Leads and consumer data provided by FusionByte are delivered solely for lawful marketing, evaluation, or contact purposes consistent with the consumer’s consent.

Buyers and partners agree:

  • Not to resell, redistribute, sublicense, or repurpose leads without written authorization

  • To use leads only in compliance with applicable laws

  • To maintain secure handling of personal data

  • To honor opt-out and revocation requests promptly

  • To maintain appropriate call scripts and disclosures


7. Buyer Compliance Responsibility

Buyers acknowledge that:

  • They control how leads are contacted, dialed, messaged, and scripted.

  • FusionByte does not control buyer dialing systems, call frequency, messaging content, or compliance execution.

  • Buyers are solely responsible for compliance with TCPA, state laws, carrier rules, and internal policies once leads are delivered.


8. No Legal Representation or Guarantees

FusionByte does not provide legal advice, compliance certification, or legal guarantees regarding buyer usage of leads.

Each buyer is responsible for independent legal review and operational compliance.


9. Incident Handling and Cooperation

FusionByte may:

  • Investigate suspected compliance violations

  • Suspend traffic sources or buyer access

  • Cooperate with lawful investigations

  • Request documentation from partners when necessary


10. Policy Updates

FusionByte reserves the right to modify this policy at any time. Updates will be posted on the Website and become effective upon posting.
